Terms of Service

These Terms of Service ("Terms") govern your access to and use of cryptoetf.today and the CryptoETF iOS application (collectively, the "Service"). The Service is operated by an independent individual developer (the "Operator").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Description of Service

The Service provides informational analytics about cryptocurrency ETF flows, holdings, indices, sentiment indicators, and estimated metrics — including average entry price and unrealized profit/loss. All data and metrics are for informational purposes only.

Acceptable Use

You agree to use the Service only for lawful purposes. You agree NOT to:

• Scrape or harvest data — in an abusive manner or at rates that degrade service for other users
• Make automated high-frequency requests — beyond normal browsing behavior
• Reverse engineer — or attempt to extract proprietary source code, algorithms, or data structures
• Bypass rate limits — or circumvent any technical access restrictions
• Interfere with or disrupt — the Service, servers, or networks connected to the Service
• Use the Service — for any illegal, fraudulent, or unauthorized purpose

Violations may result in immediate termination of access without notice.

iOS App and Subscriptions

The CryptoETF iOS application may offer premium features through in-app purchases and subscriptions processed via the Apple App Store. The following terms apply:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Subscription management and cancellation is handled through your Apple ID account settings
• All payments are processed by Apple; the Operator does not store payment information
• Refunds, if applicable, are subject to Apple's refund policy
• Free trial periods, if offered, convert to paid subscriptions at the end of the trial unless cancelled

Estimated Metrics Disclaimer

The Service computes estimated metrics such as average ETF entry price and unrealized profit/loss based on publicly available flow and price data. These estimates:

• Do not account for ETF management fees, premiums or discounts to NAV, intraday execution prices, creation/redemption effects, slippage, or taxes
• Are approximations and may differ materially from actual fund performance
• Are provided for informational reference only and must not be used as a basis for investment decisions

Not Investment Advice

Nothing on the Service constitutes investment, financial, or trading advice, a recommendation to buy or sell any security, a fiduciary duty, or a guarantee of accuracy or completeness. You are solely responsible for your investment decisions. Consult a qualified financial professional before investing.

Data Accuracy and Availability

• Data may be delayed, incomplete, or temporarily unavailable without notice
• The Operator makes no guarantee of uptime or uninterrupted access
• We reserve the right to modify, suspend, or discontinue any feature at any time

Intellectual Property

The Service and its original content, design, and software are owned by the Operator. You may not reproduce, redistribute, or create derivative works from any part of the Service without prior written permission.

Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• The Operator is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• The Operator's total liability is limited to the amount you paid for the Service in the 12 months preceding the claim, or $10, whichever is greater

Indemnification

You agree to indemnify and hold harmless the Operator from any claims, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Changes to Terms

We may modify these Terms at any time. The "Effective Date" at the top will be updated to reflect material changes. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, without prior notice.

Governing Law

These Terms are governed by and construed in accordance with generally accepted principles of international commercial law. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.

Language

These Terms may be translated for convenience. In the event of any conflict between the English version and a translation, the English version shall prevail.
